Agreement between you and Fixpal Inc. (“Fixpal”). By using fixpal.ca (the “Site”) or having your device repaired or serviced by Fixpal, you agree to these terms. Please read them carefully.

Repairs

By authorizing a repair, you certify that you are authorized to approve the repair of the device, and you understand and agree to the following.

You accept all of the risks associated with the repair. This includes, but is not limited to, the failure or functionality of any hardware or software associated with your electronic device, cell phone, tablet, computer or data storage device, including any failure that occurs while attempting the repair.

You are aware of the importance of backing up your data and software. Fixpal is not responsible for any data loss. You agree not to hold Fixpal responsible for the loss or corruption of, or the consequences of failing to recover, any data or software on your device or data storage device.

In-store electronic signature

By signing the intake signature, you agree that your electronic signature is the legally binding equivalent of your handwritten signature. Whenever you sign electronically, it has the same validity and meaning as your handwritten signature. You will not, at any time in the future, repudiate the meaning of your electronic signature or claim that it is not legally binding.

Accessing data on your device during pre- and post-repair testing

As part of our required assessment and testing, certain applications that contain customer data (such as the front and rear cameras, dial pad and messaging apps) may need to be opened to fully test the device. This is essential so we can confirm we have repaired your device to the best of our ability.

This information is never intentionally exposed in any way, and it will never be mishandled or sold to third parties for any purpose. Fixpal will never transfer or copy data on a customer’s device to any other equipment without the customer’s express consent, unless doing so is required to complete the services the customer requested.

Payment for repair service

Payment must be received in full before the device is returned to the customer.

If a device is not picked up within fourteen (14) days of the repair being completed, it becomes the property of Fixpal Inc. You understand and agree that Fixpal may then, at its discretion, recycle, donate or sell the device, or otherwise recover the cost of parts and labour.

A non-refundable repair deposit may be required for parts that need to be special-ordered.

Replacement repair parts

You recognize and agree that Fixpal Inc. is an independent, third-party repair company and is not affiliated with Samsung, Google, Apple or any other original manufacturer. Like any repair provider outside the original manufacturer, Fixpal does not always have access to original equipment manufacturer (OEM) parts.

You agree that any damaged parts removed and replaced during a repair become the property of Fixpal Inc. Upon payment for the repair or service, you give up any claim to the replaced parts or their value.

Manufacturer warranties

You recognize that Fixpal is an independent third-party repair company, not affiliated with any original manufacturer or insurance company, and that having your device repaired or worked on by Fixpal may void a manufacturer warranty or your ability to use an insurance provider. Fixpal is not responsible for any warranty that is considered void after a repair by Fixpal.

Indemnification

You agree to indemnify, defend and hold harmless Fixpal Inc., its officers, directors, employees, agents and third parties from any losses, costs, liabilities and expenses (including reasonable legal fees) relating to or arising out of your use of, or inability to use, the Site or our in-person services; any content you post; your violation of these terms or of any rights of a third party; or your violation of any applicable laws, rules or regulations. Fixpal Inc. reserves the right, at its own cost, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, in which case you will fully cooperate with Fixpal Inc. in asserting any available defences.

Liability disclaimer

The information, products and services included in or available through the Site may include inaccuracies or typographical errors. Changes are periodically made to the information on the Site. Fixpal Inc. and/or its suppliers may make improvements and/or changes to the Site at any time.

Fixpal Inc. and/or its suppliers make no representations about the suitability, reliability, availability, timeliness or accuracy of the information, software, products, services and related graphics on the Site for any purpose. To the maximum extent permitted by applicable law, all such information, software, products, services and related graphics are provided “as is”, without warranty or condition of any kind. Fixpal Inc. and/or its suppliers disclaim all warranties and conditions with regard to this information, software, products, services and related graphics, including all implied warranties or conditions of merchantability, fitness for a particular purpose, title and non-infringement.

To the maximum extent permitted by applicable law, in no event shall Fixpal Inc. and/or its suppliers be liable for any direct, indirect, punitive, incidental, special or consequential damages, or any damages whatsoever, including without limitation damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the Site; the delay or inability to use the Site or related services; the provision of, or failure to provide, services; or any information, software, products, services and related graphics obtained through the Site or otherwise arising out of the use of the Site, whether based on contract, tort, negligence, strict liability or otherwise, even if Fixpal Inc. or any of its suppliers has been advised of the possibility of damages. Because some provinces and jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you. If you are dissatisfied with any portion of the Site, or with any of these terms, your sole and exclusive remedy is to stop using the Site.

Changes to these terms

Fixpal Inc. reserves the right, in its sole discretion, to change these terms. The most current version supersedes all previous versions. We encourage you to review these terms from time to time to stay informed of any updates.
